Terms & Conditions,

We hope that you’ll love Earthmonk clothes and that you’ll be inspired by the messages they carry.  It’s also important to us that you enjoy your shopping experience with us and that you understand how we process, despatch and deliver your goods as well as your rights and our duty to you.

Whilst it’s not the most exciting read our Terms & Conditions of Trade and Terms & Conditions of Use set out all the information you need to know when shopping with Earthmonk.  Please remember that you are bound by these terms and conditions when you purchase from us.

We are Earthmonk Ltd and we are registered in the United Kingdom.

We will endeavour to respond to your email within two hours.  Our working day is 9am – 5pm Monday to Friday.

Payment

We accept payment from most major credit and debit cards.  Billing will appear as Earthmonk Ltd.  We will only despatch goods once payment has cleared.

For your security when using a credit or debit card the billing name, address and phone number must match those on the card used for payment.  We reserve the right to cancel or delay any order where the details provided are incomplete or fails to meet these criteria.

To help protect all our customers we reserve the right to notify the police and cancel or delay any transaction that appears to be fraudulent.

Earthmonk does not sell products for purchase to anyone under 18 years of age.

Products and stock

We make every effort to get a true and accurate likeness of all our products so you know exactly what you’re buying.  However depending on the resolution of the electrical product you are using to view our website, colour variations may occur.

While we endeavor to ensure that our garment measurements are accurate slight variations can sometimes occur.

We work hard to ensure our stock levels are accurate, however sometimes errors occur. If your goods are not in stock we will contact you as soon as possible to notify you at which point you can decide if you want to cancel or change the order.

Pricing

We reserve the right to alter the pricing of our products without notice.

Prices on the website do not include delivery but your options are clearly set out under ‘Deliveries’ and when you click to purchase.

Prices shown are correct at the time of publishing and are inclusive of VAT for all UK and EU countries.  This is subject to change without notice.

For countries outside the EU VAT is not charged and will be discounted from the product cost at the checkout.  However it is worth checking with your local customs office before placing your order so you are clear about any import duties and taxes you may incur.  If you do not pay custom charges then your goods may be retained, destroyed or returned to us.  Situations such as these, although rare, can affect our ability to give you a full refund especially if we don’t have the goods or have incurred a charge.

Our prices are checked regularly.  However if a pricing error is found then we reserve the right to (a) advise you of the correct price and arrange payment of any additional sum or (b) refund you for any over-payment you have made.   If you do wish to proceed, your confirmation will constitute a new order and we will supply the goods once we have sent you a despatch confirmation email. Should you wish to cancel the order a full refund will be provided.

Placing your order

Provided we have the item in stock, orders placed before 12 noon (Mon – Fri) will be processed the same working day. Orders placed after 12 noon will be processed the following working day. Postal options vary according to your country of residence (refer to details under ‘despatching your order’ below. .

If we don’t have the stock, or if there is going to be a delay in despatching your order, we will contact you as soon as possible and provide you with a new estimated delivery date.  Should this not be convenient you will, of course, have the right to cancel the order and receive a full refund.

If you change your mind after you have placed your order, contact us as soon as possible by email and we will do our best to cancel it.

How we process your order

Our first email confirms that we have received your order.  It does not guarantee that we have the stock or that we can fulfil your order as sometimes other customers can nip ahead of you when ordering.  While we apologise for any inconvenience this may cause, we cannot be held liable or responsible if your item(s) are not in stock.  We will contact you as soon as possible if your order cannot be fulfilled.

Our second and final email confirms that we have received payment, processed and despatched your item. We will also send you your Royal Mail or DPD tracking number. Please note that for environmental reasons we do not print off paper receipts for inclusion in your delivery package.  Instead an electronic copy of your receipt can be downloaded straight from your confirmation email.

Despatching your order

To ensure the safe arrival of your goods all Earthmonk products are despatched by Royal Mail or DPD and require a signature upon delivery.   All the delivery times quoted here are based on the standard working week (Mon- Fri excluding UK public bank holidays). The details below are summarised on the Delivery page of our website.

UK Mainland Deliveries

Royal Mail 48hr Track & Trace Service – £2.95

This service is subsidised by us to ensure you get the best track and trace service at a standard delivery price.  This service takes two working days and requires a signature upon delivery.

DPD Next Day Delivery (by 1pm) – £6.50

Ideal if you want your goods to be with you the next working day. This service ensures delivery before 1pm the next working day.

DPD Saturday Delivery – £12.99

A guaranteed and tracked service that ensures your parcel is delivered on Saturday before 1pm (order to be placed no later than 12 noon Friday).

Please note we cannot accept next day deliveries to the following postcodes. AB13, 14, 21-23, 30-45, 51-56, 99 and all IM – Isle Of Man, BT – Belfast, IV – Inverness, PH – Perth, PA – Renfrewshire, KY – Kirkcaldy, KW – Orkney Isles. TR20,21,22,23 – Truro, HS – Isle Of Lewis, ZE – Shetland, GY – Guernsey, JE – Jersey

EU & International  Deliveries 

DPD standard service (7-10 working days)

EU – £9.99

At present we are unable to deliver to Romania and Cyprus.

International – £15.00

At present we are unable to deliver to every country.  We currently despatch to Canada, Canary Islands, Gibraltar, Japan, New Zealand, Norway, Switzerland and the USA.

Delivery of your goods

Please note that all our postal services require a signature upon delivery.

If there is no one to sign for the parcel Royal Mail will leave a calling card.  This card provides contact details and a unique reference number for your goods.  The card details how you can collect the parcel in person from your sorting office.

For our next day delivery service, we use DPD, who offer a one-hour delivery slot so you don’t have to wait in all day to sign for your parcel.  Before they send the goods out for delivery in the morning they will send you an SMS text message and an e-mail telling you during which hour they expect to deliver your goods. For this reason, we encourage you to include your mobile phone number as well as an e-mail address for us to confirm your order details.

If you are not in when DPD call, they will leave a notification card.  They will automatically redeliver your parcel one more time but you can use the code number on the back of the notification card to organise the re-delivery option that best suits you.  It is possible for you to change the delivery date, arrange to leave a parcel somewhere safe at the delivery address, deliver it to a neighbour of your choice, drop it off at one of 2,500 local shops linked to the DPD service or come to collect it yourself from the depot.  Full details of these options can be found on the DPD website.

Should DPD be unable to deliver your parcel after their second and final attempt your goods will be returned to Earthmonk Ltd. This may take up to 10 working days.

Any goods that are returned to us without being delivered will be added back into our stock and your account will be credited minus the return charges we have incurred from the courier.  If you still want the product you will have to start a new order.

We would like to hear from you if your parcel is damaged when it arrives.

 Want to return or exchange your item?

While we hope that you will be delighted with your goods,  if you wish to make an exchange or return, you will need to obtain a Returns Authorisation Code (RAN).  The code can quickly and easily be obtained from our website in the Returns section through filling in the Online Returns Form.  You must request your RAN number and return your goods to us within 21 days of purchase.

Unless faulty please ensure that the goods you are returning are unused, in a re-saleable condition and in the original packaging.

Unfortunately, we cannot refund the return delivery charges for returns or exchanges (unless the goods are faulty in which case we will send out replacement goods free of charge).

Please be advised that you are responsible for the returned item until we receive it; for this reason, we always advise our customers to request Proof of Posting from the Post Office and to keep this slip safe.  The best guarantee of us receiving the goods you are returning is a service that requires us to sign for it upon delivery so this is something that you might like to consider.

Returns

Provided the returned goods meet the above stated criteria, a refund will be made direct to the credit or debit card originally used to place the order.  The refund will be made within 3 working days of the item being received by Earthmonk.

Exchanges

All exchanges should take no more than 3 working days from when your item(s) arrives back to Earthmonk. If you need an exchange quickly, we recommend placing a new order for the product online, so it is shipped instantly, and then requesting a refund for the item being sent back.

Within the UK we will post the exchange(s) back out to you free of charge via Royal Mail 48 hr track and trace service. Please note that we are able to offer a free mail service on our exchanges for one exchange process only (though this can be for multiple garments in the same shipment). If a second exchange is required, we will charge a postal fee.

Within Europe and Internationally, unfortunately we are not able to offer a free postal service for exchanges. We therefore request that you return your goods via the outlined returns process above and place a new order.

Faulty goods

We do our utmost to ensure that all our products are of the highest quality. However occasionally items arrive that are damaged or faulty.  Should this happen please contact us as soon as possible via email to let us know.

Please refer to our Returns page for details on how to return your product.  As soon as we have received and inspected the faulty item we will send out the replacement goods free of charge or refund its cost.

Should your item be faulty we will refund the cost of your return postage.  Please make sure that you ask for a proof of posting certificate from your Post Office so that we can refund your postage costs.

Non Delivery

You must get in touch with us as soon as possible if your goods do not arrive on the date you are expecting.  If you live in the UK you must contact us within 7 days from the date you placed the order or we might be unable to offer you a refund.

Copyright

Copying and printing elements of this website are permitted solely for the purpose of placing an order with us. You must have written permission and pre-consent to use the material on our website for any other purpose.

We take great pride in our unique artwork and graphics and, while we hope you love our designs, you will be infringing copyright if you reproduce, distribute or make derivative works of our images without permission from us to do so.

Electronic Communications

As we are a web-based company most of our communication with you will be electronic. We will contact you by email and / or provide you with information via notices on our website.  For contractual purposes you must be prepared to consent to receive emails from us and agree that this form of electronic communication satisfies any legal requirement for written communication.

Security and Privacy Information

Earthmonk is committed to protecting the privacy of all its customers, site visitors and charitable partners. We use the information we collect to process orders as well as to create a more personalised and pleasant shopping experience for you.  No information collected by us on this site will be sold, rented or loaned.  Our primary aim in collecting personal information is to ensure that visitors to our website have an excellent, personalised online experience.

Personal Information

This is information specifically about you as an individual person and would include things such as your name, e-mail address, delivery/billing address, telephone number and credit or debit card details. This information is essential to process and despatch your order and notify you of any problems that may arise.  We only ever use your personal information to provide you with the best possible customer service.

Non-Personal Identifiable Information

This is information that does not by itself identify you as a specific person.  It covers areas such as the URL that you came from, which URL you go to next, what browser you are using and your Internet Protocol or IP address.  This generates lots of useful information for us from broad demographic information to monitoring the level of activity on our site. It can give us information on dates, times and frequency of your visit and the orders you make.  It can even give us more detailed information such as the type of server being used, the website you came from, the operating system, default language, applications and plug ins.  All in all, it helps us to monitor, develop and improve our website and enhance our customers’ shopping experience.

When using third parties to perform functions on our behalf, such as processing credit card payments, our contractors do have access to your personal information to carry out their tasks but they may not use it for any other purpose.

We do not collect any information about individuals, except where it is knowingly and specifically provided. We never sell or share any information about you as an individual or user of our website unless you personally agree to it.

Competitions and Promotions (non-transactional data)

If you enter a competition, sign up to a promotion, take part in a survey or agree that we can stay in touch with you about new products and services, we may ask you for personal contact information. When you enter a competition or promotion you are giving us consent to use this information and it enables us to contact you if you should win.  You can opt out of this if you wish and we will never pass these details on.

If you have a valid promotional code, then you can enter it into the Promo Code box that can be found on the checkout page.  Please note that promotional codes do have restrictions and normally run for a limited period of time.  They are subject to change and can be withdrawn at any time.  Only one promotional code can be entered per order.

Data Protection

We value your custom, your privacy and the trust you place in us in handling your data.  We take every reasonable step to protect your data and it is stored by us on a secure server.  We use a system that encrypts all personally identifiable information you input when you place your order before we receive it.  Please note that Earthmonk does not store or retain your payment card details on its servers.  All payment information is handled and processed using our payment gateway – Stripe.

We may disclose your data to the police, legal advisers or regulatory bodies in connection with any alleged criminal offence, fraudulent activity or when required by law.

Cookies

Cookies are small pieces of data stored by your browser on your computer’s hard drive that make web browsing easier and quicker for you.  Websites can also use cookies to compile data on traffic and visitor activity as well as revealing the most popular areas on the site and site usage. Cookies are anonymous and use a randomly generated number to identify themselves and therefore do not contain any information that could identify you in any way.

At Earthmonk we use cookies to make our website work as efficiently as possible for visitors and customers.  We also use the information gleaned from the cookies to improve our website and the online experience for everyone who visits our site.

Most web browsers atomically accept cookies. Although you may disable them, it is important to note your customer experience may be affected.
